As long as you are not using a modified-version, you can always keep using IP Filter without any restrictions. Yeah it has been removed, blame it on Darren who tried to make himself well-known and be a smart ***. Talking about the smartest person on the web, it's not Bill Gates, neither is Linus Torvalds. Instead, Dan Bernstein is the one (qmail author and his other great software) who deserved it.
Don't forget, IP Filter doesn't always need to be compiled into the kernel to work, it can always be stand-alone. In fact, running it stand-alone is more dynamic, it might not be as reliable if it makes any difference. So why not just fetch the IP Filter tarball and compile it yourself?

I asked if NetBSD was removing ipfilter (like OpenBSD has done) in #netbsd and the answer was no.
