Does that mean the 'act' of sharing material over the internet has been made illegal, does that include sharing material that isn't actually copyrighted?

Well, not exactly. It seems to ban "inducing someone to break copyright". Supposedly (at least according to Orrin Hatch, oops, I mean the RIAA speaking through Orrin Hatch), people are inducing young children ("Think of the children!") to make copies of copyrighted material for them, and then profiting off those copies.

Or something.

But while the supposed "intent" is not to ban filesharing outright, that's the effect. And that's why it needs to be killed, and quickly.
